1. Purpose of Services
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Onyx Drive Paris (hereinafter "the Company") and any natural or legal person (hereinafter "the Client") using its luxury chauffeur-driven vehicle (VTC) services.
Any booking implies the Client's full and unreserved acceptance of these GTCS.
2. Booking and Pricing
Booking Process
Bookings are made via the website, telephone, or WhatsApp. A booking is only considered firm after confirmation by the Company and, if applicable, receipt of payment or a bank guarantee.
Pricing Base
Our rates are calculated on a premium base including:
- Direct trip: €3.00 per kilometer traveled.
- Minimum fare: €40.00.
- Premium Van surcharge (4-7 pax): +€30.00.
- Airport Flat Rates (CDG/Orly): Minimum €120.00.
- Hourly Service (As Directed): €80.00 per hour (minimum 3 hours, i.e., €240.00).
3. Cancellation Policy
Any cancellation must be notified in writing (Email or WhatsApp). The following fees apply:
- More than 24h before departure: Free cancellation, full refund.
- Between 24h and 4h before departure: 50% of the total fare will be invoiced.
- Less than 4h before departure or No-Show: 100% of the total fare will be invoiced.
4. Client Responsibility and Damage
The Client is responsible for their behavior and that of their passengers on board the vehicle. The Company reserves the right to interrupt the service without refund in case of inappropriate, illegal, or dangerous behavior.
Penalties for damage:
- Smoking on board: €150.00 (Textile cleaning and deodorization).
- Significant soiling (Vomiting, etc.): €250.00 minimum (Professional cleaning and vehicle downtime).
- Material damage: Invoiced at the actual cost of repairs upon presentation of a quote, plus a downtime indemnity of €400/day.
5. Non-Competition and Non-Solicitation Clause
The Client is expressly prohibited from soliciting, hiring, or dealing directly with the Chauffeur provided by the Company for future services without going through the Onyx Drive Paris platform. Any breach of this clause will result in a fixed indemnity of €5,000 due by the Client to the Company.
6. Force Majeure
The Company cannot be held responsible for any delay or failure to perform the service resulting from a case of force majeure (serious accidents, exceptional traffic jams, extreme weather conditions, attacks, strikes, etc.). In these cases, the Client may be refunded if they could not be picked up, but no compensatory indemnity can be claimed.
7. Jurisdiction and Applicable Law
These GTCS are subject to French law. In case of dispute, and after an attempt at amicable resolution, the competent courts will be those of the Company's registered office.
